Stair riser heights shall be 7 inches 178 mm maximum and 4 inches 102 mm minimum. Stair tread depths shall be 11 inches 279 mm minimum.
Handrails. The same height rules apply to stairs, and the inspector measures the handrail height from nose of the stair tread. The handrail, itself, should be easy to grip, with a minimum diameter of 1 1/4 inches and a maximum diameter of 2 1/4 inches. You cant use a two-by-four but a two-by-two as a handrail would meet code.
Code and Design Assistance. Basic American Residential Stairway Requirements Residential Code. Height of the handrail. For a rake is typically between 34 and 38 inches 864 and 965 mm , measured to the nose of the tread. The ideal rake height is 36 inches. The minimum height of a balcony handrail is 36 inches 914 mm and no more than 42 inches tall.
The building code requirement for stair railings typically requires handrailings on stairs that have a total rise of three feet or more. Certainly the stairway that we observed in La Huerta, Mexico photo at left as well as the rooftop deck do not meet current safety standards.
Handrails extend at the slope of the stair flight for a horizontal distance equal to one tread depth beyond the last riser nosing Note: This is a relatively recent change. Some jurisdictions still require a tread depth plus 12" beyond the last riser nosing. 12" min. 1 tread width 1 tread width 12" min.
Build a new stairway Building permit and inspections to current Code. Stair width. New stairways must be at least 36 inches wide from wall to wall above the handrail except spiral stairs. which must be at least 26 inches wide from center post to outside edge of tread .

Risers must have a maximum variance of 0.375 inches between the highest and lowest risers on the staircase. Risers must have a maximum height of seven inches and a minimum height of four inches.
Handrail heights on stairs and landings. This height is acceptable because the function of a handrail is to provide safety on a stair flight and its height on a landing is not critical. The handrail and barrier can rise to the 1100mm height over a transition zone about 300mm long, depending on the stair slope.
Where the nosings of treads at the side of a flight extend under the edge of a floor opening through which the stair passes, the floor opening shall be allowed to project horizontally into the required headroom a maximum of 43/4 inches 121 mm .
Deck Railing Codes. Handrail ends must be returnedand terminated at rail posts. The handgrips must allow a minimum of 1-1/2 spacebetween the handrail and the guardrail or wall. The riser requirements for the OSHA, IBC and IBC-related Los Angeles Building Department regulations have minimums and maximums that conflict with the requirements in the other two. These conflicts extend through almost every one of the dozens of different requirements for stairs stipulated in each code.
A handrail is in place to provide guidance on a stair. It is required when you have two or mores risers on ramps with a rise greater than 6 inches. A guard is in place to prevent an accidental fall. In the U.S., the I-Codes require a guard if there is a 30 drop while in Canada, a guard is required once there is a 24 drop.

Under these provisions, while construction work is being performed, a separate handrail must be provided if the top rail of a stairway system exceeds 37 inches. Since the top rail you refer to is 42 inches, a separate stair rail would be required. The different height requirements reflect different purposes.
